Developmentally Disabled and Special Needs
 

Parents and families of developmentally disabled or special needs individuals face unique legal planning issues. While the field of practice is known as "Elder Law," this is somewhat of a misnomer. Most "elder law" attorneys also provide services concerning the developmentally disabled, as the legal issues presented are very similar: familiarity with available public benefits programs, substitute decision making for the legally incapacitated individual, and understanding available community resources. The elderly and the developmentally disabled also share similarities in their vulnerability and dependence on others.

At San Diego Elder Law Center, we understand the important relationship between the families of the developmentally disabled, the San Diego Regional Center, and their licensed vendors. We understand State laws and regulations concerning the developmentally disabled and those providing services to them. We are familiar with community resources and the requirements of Regional Center and Community Care Licensing. Most importantly, we understand the available public benefits programs and are experienced in handling long-term planning to assure the future security for the special-needs individual. If done properly, "special needs trusts" can be established that will not disqualify a recipient from means-tested public benefits. We are also experienced in handling problems related to the legal incapacity of the adult developmentally disabled individual.
